Terms of Service
These Terms govern your use of ComputerWorld, the hosted service at computaco.ai, its API, console and documentation (the “Service”). The Service is provided by COMPUTACO INC., a Delaware corporation and a subsidiary of CommandAGI INC. (“Computaco”, “we”). By creating an account or using an API key you agree to these Terms. If you use the Service for an organization, you accept them for that organization and confirm you may.
1. Accounts and keys
You must give accurate account information and keep your password and API keys secret. You are responsible for everything done with your account and keys. Tell us promptly if you suspect misuse. You must be at least 13 years old, and old enough to form a binding contract where you live.
2. The Service
ComputerWorld runs simulated computers, applications, people and an internet. Everything inside a world is simulated: no world reaches the real internet, and nothing a simulated person, bank, shop or agency does has effect outside the simulation. We may change, add or remove features, quotas and limits, and may suspend worlds that exceed them.
3. Acceptable use
You will not: break the law or help others break it; attempt to reach systems outside the simulation, defeat isolation, quotas or rate limits, or probe the Service’s security without our written permission; overload the Service; resell or provide it to third parties as a standalone service without our agreement; use it to build a competing simulator from our outputs; or use simulated content to deceive people outside the simulation.
4. Your content
You keep your rights in the worlds, procedures, specifications and other material you submit (“Your Content”) and in the outputs your runs produce. You give Computaco a limited license to host, process and transmit Your Content only to provide, secure and improve the Service. You are responsible for having the rights to Your Content.
5. Model-driven features
Some features (for example simulated people in a swarm) send prompts to third-party language-model providers when you enable them. Do not include personal or confidential data in material you send through those features. Outputs from models may be inaccurate.
6. Our property
The Service, the ComputerWorld engine, worlds we provide, and their documentation are owned by Computaco and its licensors and are protected by law. Except for open-source components distributed under their own licenses (such as the MIT-licensed client libraries), these Terms grant you no rights in them beyond using the Service. If you send us feedback, we may use it without obligation.
7. Fees
Plans. The Service is offered on the plans described on our pricing page: Free, with the quotas shown there; Pro, a paid subscription with higher quotas; and Enterprise, available only under a separate written agreement with Computaco, which governs where it differs from these Terms. We may change the quotas of any plan as described in section 2.
Pro billing. Pro costs US$29 a month, billed monthly in advance, through our payment processor Stripe, Inc., to the payment method you give it. Payments are collected on Computaco’s behalf by its parent company, CommandAGI INC., through CommandAGI’s Stripe account, so your receipts and card statement may name CommandAGI as well as Computaco. Prices exclude taxes; you pay any sales, use, value-added or similar tax that applies, which will be shown at checkout or on your invoice. Your subscription renews automatically each month until you cancel it. You authorize us, through Stripe, to charge the price of each period when it begins.
Cancelling. You may cancel at any time from Manage billing in the console. Cancellation takes effect at the end of the period already paid for, and your account then returns to the Free plan. Fees are not refundable, and we do not refund partial periods, except where the law requires it.
Failed payments. If a payment fails, your subscription becomes past due and we keep your Pro quotas for a grace period of 7 days while Stripe retries the payment. If it is still unpaid after that, your account returns to the Free plan; worlds and other resources above the Free quotas are kept, but you cannot create more until you are within them.
Price changes. We may change the price of a paid plan by telling you at least 30 days before the change applies to your next renewal. If you do not agree, cancel before then.
Discount and referral codes. A code we issue gives the discount it states, on the plan it names, for the duration it states: “forever” means for the life of the subscription it is applied to, and ends if that subscription ends; “once” means the first invoice; a number of months means that many monthly invoices. A code may be redeemed once per account, is not transferable, has no cash value, and cannot be combined with another code. A code may be limited to a number of redemptions or an expiry date, and ends when either is reached. For example, FIRST100 gives 20% off Pro for the life of the subscription to the first 100 accounts that redeem it. We may withdraw a code obtained or used in breach of these Terms.
8. Suspension and termination
You may stop using the Service and delete your account at any time. We may suspend or end your access if you breach these Terms, if required by law, or to protect the Service or others. On termination we may delete your worlds and data.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free or that simulations match real systems.
10. Limitation of liability
TO THE EXTENT PERMITTED BY LAW, COMPUTACO WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOST PROFITS, DATA OR GOODWILL. COMPUTACO’S TOTAL LIABILITY FOR ANY CLAIM ABOUT THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AND US$100.
11. Indemnity
You will defend and indemnify Computaco against third-party claims arising from Your Content or your breach of these Terms.
12. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws rules. Disputes will be heard in the state or federal courts located in Delaware, and both parties consent to their jurisdiction.
13. Changes
We may update these Terms. We will post the new version here with a new effective date and, for material changes, notify account holders. Continued use after a change takes effect means you accept it.
